How do we get personal jurisdiction over out of state debt collectors and their attorneys in and FDCPA case? They are using personal jurisdiction and venue in their MTD which will be denied if it is transferred from Georgia to Florida. I was damaged in Georgia and they mailed letters and their attempts to collect a debt to me in GA. This defies everything the CFPB etc put out to protect consumers when debt collectors violate the law.

Hello Sherrie,

Did you check your state licensing/permit agency? Many of these credit agencies are licensed in several states,even though their headquarter is in their home state.

Some agencies can be tricky by filing a DBA (doing business as)that is different from their parent company. Verify with the BBB website.

I had a situation with a collection agency myself.
They were headquarter in one state, but trying to collect in my state.

Get a "certified copy" of their license to operate in the state in question. And have the certifying officer write an affidavit, stating the document is a true copy taken from the public records of that office.

If you should go to court, this should be the proof you need of personal jurisdiction.
