Recently a coworker to me of a city ordinance in which home owners will receive a citation for not keeping their lawns trimmed. I told him that the city has no lawful authority. He went on to tell me that the city will have the homeowners lawn cut and place a lien on the property. I told him that government statutes are only internal to the government. Well, he didn't believe me, because he knows many people in which this has happened to.
Now I had to dig into the books to make my point. I found the proof in the City Charter!
In the Preamble of the Charter, "We the citizens of Altus, Oklahoma,... establish this charter for the City of Altus, Oklahoma." It goes on to state that "The City of Altus, Oklahoma, within the corporate limits...now belongs to the corporation known as the City of Altus..."
Additionally, I went to the credit rating agencies which rate businesses. There are two: Duns & Bradstreet, and Manta. The City of Altus is listed as "a Privately Held Company in Altus, Oklahoma."
With this proof, I told my coworker that there are two entities:
1. the government, called Altus, Oklahoma.
2. a corporation, called City of Altus, Oklahoma.
I told him that this corporate entity can NOT compel a homeowner to perform, no more than the corporation IBM, or McDonald's can compel performance.
The citation actually is an offer to contract...written in Negative Averment form. This means that your failure to response will be taken as acquiesce.
And the lien which is later placed on the property is no more than a Mechanics Lien. The same type of lien a contractor would place on your home if you didn't pay for the work performed.
I looked up several cities, and found similar Charters, which created a "corporate legal entity" for managing the affairs of that government.
Therefore if you are sent a Notice from the "CITY OF...",
you know that you are dealing with a corporation who wants to contract with you.
