i filed bankruptcy and included my personal injury and it is listed. we have gone two times to court and the insurance attorney has gotten two different courts/judges to agree, this case can not proceed without permission from the court. the bankruptcy and my attorney said the case can proceed as it is listed, the judgement has not been made and when judgement is made, anything above $7500 would have to be forwarded to the court. i am rescheduled to go to third hearing Dec. 7 2017. Is there anything I can do to keep dismissal or force the judges and the insurance company to obey the higher court law..as civil court is inferior and i am getting the run around...so far judges are working and agreeing with known crooked attorney representing a poplar insurance company

It would appear that someone, possibly your own lawyer, is not understanding how bankruptcy works. Typically, once bankruptcy is filed the petitioner (or his lawyer) files a paper entitled something like "Suggestion of Bankruptcy" or "Notice of Bankruptcy", and the civil court loses jurisdiction until the matter is settled to the satisfaction of the bankruptcy trustee and bankruptcy judge. Also, many people fail (or their reputed lawyers fail) to list ALL and EVERY debt the petitioner owes and, if the bankruptcy goes to completion those debts remain and are NOT DISCHARGED. Please proceed with caution and, perhaps, get a second opinion from another bankruptcy attorney who can review your files and put you on the best footing. Good luck!
