If I respond in a timely and properly certified manner in a proper format, to each and every "paper" they toss at me, then they shouldn't be able to trip me up, right? And if they're frivolously tossing MTDs and "body attachments" and Rule 11s, should I do the same?
Here's what a few said:
"I've told the defendant is to respond to my complaint in writing by affirming or denying what the complaint says. Any Answer filed will likely be legally insufficient."
[Why would a pro-se's Answer (admit/deny/no knowledge plus affirmatives) be legally insufficient?]
"Just wait and see if they file an Answer. If they do then file a MTD or Demurrer (whatever it's called in your jurisdiction). It's usually possible to do so against an Answer, though obviously not common. That is how you deal with pro ses, just paper them as it's not possible for them to understand all the court rules. You will probably get a default judgment one way or the other, or win via a MTD. Just attack the pleadings non stop."
[It seems to me an Answer or Reply is pretty straight forward; would a regular lawyer be surprised to see a correct format as a student of Jurisdictionary would present?]
"The senior partner at my firm has no problem filing Rule 11's and filing Motions to Compel and taking sanctions. He files show cause motions and body attachments. I asked his advice, and he suggest I overload them with requests for admissions before they can answer and confuse them. "
[What a senior jerk...but I don't understand this 'overload them with R4A before they can answer'...senior jerk must be referring to the Answer to the complaint. Can he start Discovery before the Answer is even proffered? It shouldn't matter, if the pro se doesn't get confused by this]
"If you are in a jurisdiction where losers pay costs, be prepared to ask for them and keep record of all the help. This is where their lack of knowledge with procedure can be important."
