File complaint against attorney for overbilling
07/18/22 11:35 PM

Hello, is there an example letter to write to an attorney to dispute their fees, over billing and no end result?

Originally I had an attorney, complaint filed, discovery set in motion. 3 months later my attorney wanted a deposition, but what was this actually for, as the deposition was not used in any way to leverage the case, no results came from the deposition. Months went by and case did not get any closer to resolution. The respondent attorney filed a motion to abate the case for 6 months. Then there was even a Mediation and my attorney was not prepared, she gave me a 2 day warning that there was going to be a Mediation, she did not review the updated financials I sent her and did not assist with any negotiation and also, this produced zero results. I could no longer afford having ongoing counsel month-to-month and I am now handling my case, pro se. Over $26,000 was paid during the past 10 months and no end result.

I want to write a letter to sent registered mail to the attorney to advise that I am disputing the amount of time the attorney actually needed to spend on the deposition, she must not have reviewed my financials well and hours could not have been spent creating that excel spreadsheet that produced no results.

Thank you for your insight.

I actually did file a complaint with Oregon Bar and it worked! The Oregon State Bar asked for both arguments, then responded back citing 'block billing' for 20 min for each task and the 'closing' of my file was over $3,000, ridiculous, so what did I have to lose and it turned out in my favor, very grateful. Thank you for this website, the people for the people.
