Supervised release v constitutional rights
03/04/23 12:54 PM

Hello to all. Can someone please clarify (if they know certain) when someone is on federal supervised release (me of course) are constitutional rights lost.

In short, I already know rights are limited to the tailored made offense. But what happens if there are special conditions in my SR that do violate my rights that has nothing to do with my charge???? Do I say the heck with it and exercise my rights and do what they don't want me to do and then attack the merits if they arrest me, or do I file a motion saying it's unconstitutional. I actually did that but of course the judge didn't give me the time of day to even argue my arguments. Just dismissed mainly because the judge said my rights were not violated..... But again I know that, my rights are not violated until I knowingly break probation to exercise my rights... Thanks to whoever may provide feedback
