Insufficiency of process

Could a failure to note in a Petition served on a Respondent that the court has heard ex parte testimony from the Petitioner, (but the testimony is not in the petition) be grounds for dismissal of the Petition? Does this fall under the heading of a insufficiency of process in that the Petition is incomplete?

Any judge that "allows" ex parte communications in a case should recuse himself upon motion, if the motion is verified and provides proof of the ex parte communication. Just a thought. PLEASE TELL OTHERS ABOUT MY COURSE.
