Motion to strike answer as unresponsive
01/22/23 2:53 PM

Defendant's attorney answered several paragraphs of my complaint with "neither admits nor denys". I'm going to file a motion to strike the answers as unresponsive and deem them admitted. However, they also included a counter claim with the answer. I can't find in the Michigan court rules if this motion would toll the time to file my answer and affirmative defenses. I don't want to file answers and miss the opportunity to make my motion because the pleadings close. Thanks in advance for any insights!

RE: Motion to reopen
01/30/23 11:48 AM

My husband didn't go to court so the third party claim was dismissed against him and we ended up paying almost $40G to some lawyers.
two reasons - he didn't show up and the lawyers said that he didn't deliver the undertakings. I provided all the undertakings to our lawyer at the time and he didn't forward it on to them. Can I reopen this case?
The judge said that reopening it would break solicitor client privilege.
Another lawyer said that it is more than 30 days so too bad, so sad, can't reopen. I don't know what to do next.
Either I push to reopen or I need to make a motion to dismiss the request to reopen. Can someone help me? Thank you,
Iron curls.
