I can't seem to find interlocutory in my Jurisdictionary. I might be overlooking it and missed it. If so someone please direct me. Was looking for the format.
I am understanding a party in the case can motion for this to the appellant court. I think it is normally requested by the judge of trial court. The trial courts in our State completely ignore any case law you use (and yes it is pertinent), statutes or constitutions. These judges have no checks and balance and nobody controlling. They ignore and refuse all discovery request.
I need more information on the Interlocutory forcing the higher court to rule on the laws.

This word is an adjective used to denote an action (usually an appeal) taken when the final order has not yet been entered. Typically, an interlocutory appeal may be taken when, for instance, there has been a discovery abuse and to continue to trial without resolving the abuse would work a great hardship or prejudice the appealing party. Such appeals are typically taken using a Petition for Certiorari. Please study the Course materials on Appeals.
