Driver's License
11/07/16 12:04 AM

How do I release the hold on my Texas driver's license in Texas so I can get my driver's license in Nevada. What is the process?

Hello Jerilyn,

Did you contact the Texas DMV directly and ask them for the process?
You can also request a copy of your Driver's Record. This should indicate the reason for the hold.
The most likely reason that I can think of for the hold is unpaid tickets.

Thank you for responding. I did that they have a system called
OMNIBASE service of Texas. Which deals with Failure to appear. Denial of renewal of Texas drivers license. Failure to pay. The tickets exceed 10 years and the driver is in another state and cannot get a license in the other state because omnibase is a national data bank. Please help with a solution.

Jerilyn,

What is it exactly that you want? From your message, you were given two solutions for dealing with this situation...but it appears that you failed to act.

Your 1st chance was to pay the fine. You give the impression that you ignored that option.

Your 2nd chance was to Defend yourself in their courtroom. And your message gives the impression that you chose not to do that either.

So, your "silence in the matter" as been interpreted as acquiesce. Therefore, you resolved yourself to accepting whatever action the State deemed appropriate.

By failing to act within the time given you, you waived your Right to Due Process.

May be someone else here will offer something.

Jerilyn,

Dr. Graves course provides a guide to develop your confidence to fight your own battle.

Assent can be manifested by silence, because "a party's silence in the face of an accusation, under circumstances that would prompt a reasonable person to protest, is generally considered an admission" (Robert A. Barker & Vincent C. Alexander, Evidence in New York State and Federal Courts § 8:17 [2016]; see also People v Koerner, 154 NY 355, 374 [1897] ["If he is silent when he ought to have denied, the presumption of acquiescence arises"]).
