Criminal Vs Civil
07/04/23 9:53 AM

The court denied my motion he said if it were a civil case it would have worked but its criminal.
This is crazy, since when is an traffic infraction a criminal charge?
I'm going to file another motion to dismiss due to lack of discovery, I have not received any paperwork about this matter and they charge $500+ to get it through the police station. I truly think that is a requirement they must provide. This is very concerning what about people who cannot afford it?
Do we suffer? That is not fair at all!
Any advice would be welcome!

Peace

Read Florida rules of court procedure chapter 6 rules of traffic court. There it says that it falls under criminal court rules. Rule 6.160. Then you'll have to read the criminal procedures to see what defense you have for whatever the infection was. Hope this was of some help. Good luck with your case
