Habeas Corpus?

I'm Not sure if a Petition of a Writ For Habeas Corpus is the correct way for us to go or not!!!(?) Or when, where, how and who files it!!! I was looking for some help mainly for my wife!!! She has been incarcerated for more than 21 months on a now ruled "illegal", "unlawful" or "unauthorized sentence and her release date was last Sunday, October 22. 2017!!!! I'm looking for some way to get her released NOW!!! They set another hearing in December but they're just playing their legal "games" and she is Desperately Needed at home as I'm trying to be patient and caretaker with stage 3 cancer!!!! It's a Very long story (6 LONG Years!!!!) and we've spent every last dime we had!!!! (Over $200K on legal fees!!!!) The Appellate Court finally gave us the opportunity to withdraw our "guilty" plea which was obtained by our attorneys lying and manipulating us!!!! ( Another LONG story!!!!) We went to court on Friday which our attorneys explained to us would result in my wife's Immediate release!!!! But that didn't happen and like I said, they've set another "further proceedings" hearing for December 13th!!!! Who knows what will happen then!!!! When does this end!!!! THANK YOU FOR YOUR HELP!!!!

You need to see another lawyer, because your's is apparently not doing his or her job ... typical, unfortunately. Do not delay. God see three or four other lawyers. Odds are you might get one good one out of four ... but doing nothing will not be the answer. A Habeas Writ only brings your wife to court again and must be based on some legal or factual reason why she should no longer be restrained ... and your need for her at home is neither. Go talk to other lawyers and you will see that you may not be getting what you're paying for with the ones you have. Hope this helps.

THANK YOU for your relpy!!!! Fotunately, the only reason for her getting released isn't just based on my health condition and my "need" to have her home!!! If you noticed, our sentence was ruled "illegal", "unauthorized" and "unlawful" by the Appellate Court and she is more than a week past her release date!!! The Appellate Court also ruled we can withdraw our guilty plea and prepare to go to trial which should vacate her incarceration!!!!(???) Why else could they be holding her? I will contact a few other Attorneys immediately!!!! THANK YOU AGAIN!!!!
