Dismissed Case- Child Support
12/13/13 4:44 PM

I have a case that was dismissed with prejudice in 2008. It was resurrected by DSS and the Plaintiff saying that the dismissal was not valid. They have made no factual statements. A hearing was held with improper service and then this charade began.

I have a hearing in January to Set Aside the allegations and new order that was entered without notice and contrary to the previous dismissal.

I am looking for assistance in the legal research part of the precedence of overcoming a previously dismissed order?

In general, of course, a dismissal WITH PREJUDICE is final. It is likely one in your position is being taken advantage of. Do your research on the effect of dismissal with prejudice which, everywhere we know of, is final as to the issues raised by the dismissed action. Don't get snowballed.
