Adding Defendants to Complaint
08/16/19 6:12 PM

I made a slight error filing my suit against Wells Fargo for unlawful foreclosure actions. My complaint names FOUR Defendants and has Doe Defendants 1 thru 100. My coversheet I had to fill out for the clerk named only three of the four. So...to fix this what needs to be filed right now?

A joinder?

what I would do is file a simple notice, quick, and let the court know that you forgot to add a party. That the party will be named in documentation hereafter and a summons will be served on them.

thats what I would do.

Thanks for the info. What does a simple notice format look like? Looking through the course contents, I don't see anything specific to this.

I just called the circuit court; they don't know what this is or what it looks like and neither does legal aid.

Okay, never mind on that format. I found this: https://abovethelaw.com/2015/04/pro-se-filing-of-the-day-notice-to-fck-this-court-and-everything-that-it-stands-for/

I can make this work. Also, I'm very much in need of a vicious attack dog attorney that can step into my case and take it home. I'm fighting Wells Fargo for wrongful foreclosure. I've had a forensic audit done that is damning -- they've broken my chain of title, sold my note to Wall Street and still claim they can foreclose. I've used the pro se litigation support team at Fraudstoppers.org to create my complaint out of the raw information in the forensic audit. I've been told that I would be wise to let an experienced attorney take this over as the prejudice toward pro se litigants in the courts here is systemic. This suit was filed in Pope County Circuit Court on Friday, August 16th, 2019. So I'm looking for someone in Arkansas or who can practice in Arkansas. My complaint is seeking $100K to $2M in relief plus all the other damages allowed by law as well as a quiet title action.

Any takers? There is money on the table here waiting to be made by a lawyer that hates banks.

Stick with the course, Gerald9. The key to winning is Discovery built on solid Pleadings and pushed forward with effective Motions. Winning is easy if you have a winnable case, Gerald9.

Thanks for the encouragement. The case is winnable. My defendants have clearly broken the law. However, there is one piece of this I don't understand and if I can't explain it to a judge, I need somebody who can explain it to me so I can explain it.

I'm trying to figure out what the Tax Reform Act of 1986 has to do with anything in my case. The act itself does include a section about Real Estate Investment Trusts. The verbiage of the Act is all about readjusting tax rates for individuals and corporations. My complaint alleges there was no "True Sale" of my Tangible Note. I've been reading through this Act and I'm not making the connection between this allegation and the subject of the Act.
