This is what has happened to me in Australia Queensland. I failed to pay a fine I was unaware of and they suspended my drivers license. I was pulled over and charged with driving whist my license was suspended.

Do you have any remedy for me or some pointers to steer me in a similar direction to discover what I should do in court.

There is one thing that the People are either unaware of, or just don't know. When the government brings Criminal charges against you, they MUST meet the burden of proof with something called the "Elements Of The Crime".

If just one of those required Elements is missing, then you file a Motion To Dismiss..."for "failure to state a claim for which relief can be granted".

Now the key is finding these Elements Of The Crime. Don't expect an attorney, judge, or case law tell you. There is only one source that I have found...and it took me many months to locate this information.

There are Federal and State Criminal Elements. Where do you go? Do an online search with this phrase:

"(Your State) Criminal Jury Instructions"

I have only performed this search with a handful of states, not all 50-states. So if your particular state doesn't produce results, don't give-up. Also, I haven't tried this type of search for people in other countries.

I'll chime in, 5 years later ...
Sad, but true; corporate U.S. is the monster created by insolvency through the banking cartels of international infamy. When we show up in court, they see a business transaction target. Nothing more, and certainly nothing less.

If you've ever wondered why sometimes Constitutional defenses are disregarded or even met with hostility, here it is: you are in an Admiralty jurisdiction under Maritime Law (International Law of the High Seas), which puts us into a strange environment as far as courts are concerned. When we walk into the courtroom, we cross a "bar" before taking our place before the "judge". You have just entered into a "vessel in dry dock".

This is how they make a crime out of things that would otherwise never be so ... Bills of Pains and Penalties. In criminal cases, the essential element is an injured party for a claim to be brought (or complaint). I've been to court several times now for what is being referred to as a "Criminal" Traffic violation!! Excuse me?!!

There is Supreme Court cases in my home state as well as handed down as precedents from the United States Supreme Court that gaurantee my inherent and unalienable right to travel without molestation and police interference and that no license is necessary; nor does one's private automobile need to be registered. Registering your vehicle gives the state a secured interest in the car, making them owners. Why do you think you get a "Certificate of Title" rather than a "Title" or a "Manufacturer's Certificate of Origin"? The D.O.L. has already taken care of your allodial title (that pesky paper proving ownership). This is how they are able to legally steal your vehicle by way of impoundment! Then they have the nerve to fine you for holding it hostage, and when they sell it, they want money for storage fees above and beyond!!! That's racketeering and extortion between your local policy enforcers and the tow companies! But, I digress.

You are in a military tribunal (hence; the gold-fringed
