I was taken to court on an eviction and the eviction was dismissed and a month later was taken to court to be evicted again. I got a lawyer because by law this is not legal because it falls under retaliation. well my lawyer was worthless and so now im $5,400 in debt and my lawyer has told me he does not want to continue to represent me since I have only given him $1,000...so here is what I am trying to figure out. the judge gave me the option of either coming to an agreement with the property owners or she was going to rule in favor of them. i was simply being evicted because they did not want me there anymore, not for failure to pay. so anyway, the agreement was not signed in court it was apparently written up by the plaintiffs lawyer. i was given 90 days to move and was to pay the agent of the property who i made the agreement with when i moved in a year and a half ago $300 by the 5th of December, January, and February. so my lawyer sends me an email on the 9th of February with the agreement i am suppose to sign and in it it states that i am to pay the plaintiffs lawyer the rent for the last 3 months. now i told my lawyer i would not sign because i would be in immediate violation giving them the right to file for immediate removal. i have heard nothing back. where do i stand if this does not get signed and i am not out by the agreed date? can anyone help me please?

Hey I know the pain. I'm not a lawyer of course but suggestions-not legal advice. I don't want to be sued so 2 Suggestions 1. you could say you are Abraham Lincoln and wear a top hat to court-- my other real suggestion--you should bring to the attention of the Court that this was not the agreement. Did they state only 300$ and then change the terms to full rent? An agreement is an agreement. There is nothing to say you can't make your own agreement. Just take the agreement use same similar language and make your terms in the way you want it and fire it back at them. If you raise enough heck they may want to take your terms just to get you gone. Again just a suggestion.

This is not legal advise.

It appears, on the face at least, that the opposition is attempting some form of negotiations by extending an offer. Therefore, one could utilize this by way of counter-offer, conditional acceptance, or etc.... For more info visit the contract law section of the course.
