Prevent Foreclosure on Reverse Mortgage
06/03/14 1:33 PM

Good morning! I am rather new subscriber of jurisdictionary educational program. Please educate/teach me how to prevent foreclosure on a reverse mortgage. I was searching for the sections in the course materials that explain what should be done & how to do it. I saw a testimonial where someone had good success to win and believe it said there was "no mortgage". It would be great to talk with the person as possible. Hearing was scheduled but they postponed and haven't rescheduled. I've heard a little bit about securitization audits and Bloomberg report but just don't know enough. Please help; I need more specific & practical education on what and how to save our home. I'll willing to meet with anybody who can make suggestions and/or teach me some things.

Thank you,
Marva

-initial notice of hearing postponed
-requested CM produce the genuine note & mortgage
-CM sent letter stating there are options & they want to help
-CM later sent copy of note; package includes reference to allonge. also the copy of note appears slightly difference
-received letter from substitute trustee for amended notice of hearing, reschedule date is 8/6

You should check the authenticity of the note, as they can not send you an actual copy of the note because that would be counterfeiting ...I.e., you'll notice the size of the note is smaller that an 8.5 x 11. That being said you'll want proof that they have the original and did not securitize it. They should provided you with an affidavit on the note stating that it is in their possession and that the copy you are receiving is from that original, in their possession. The real problem is you're dealing with a tight group ( banks and courts) good luck.

John, thanks for your reply. They said they're not gonna provide note. When I called, rep stated they don't have original but certified copy is ok. is that true or do they have to produce the 'genuine' note & mortgage. Rep alleged it's in their storage. Does that sound typical. i'm new at this and trying to understand at the same time. Do I need to file any specific motions? i'm working on getting a securitization done. is that how to get proof you mentioned? Really appreciate your comment. Thanks again

hi, here's update
-filed motion for enlargement of time to Answer, Notice of Dispute; also sent QWR
-found out today, they (other side) CANCELLED amended notice of hearing on deed of trust that was scheduled for 8/6; they cancelled on 7/22 but I didn't receive any kind of notice and they wouldn't give anything in writing. is that typical? any suggestion on how to get it writing: does it matter?

clerk's ofc said they didn't give a reschedule date.

clerk's ofc didn't want me to file motion or notice of dispute into record?

so anybody experienced that before?
