I want to try to help a young man that’s already been arrested. Already had his arraignment. His last court date was supposed to be on 10/17/2022. But when I arrived for his court date set for 10/17, I heard them discussing him and saying he was a “ miss out”. So I asked the Bailiff and the attorney, “public defender”, what did “ miss out”mean. , they couldn’t explain. At least to my understanding. Anyway his next court date is on 10/31/2022. They want to charge him with a whole felony because of pure foolishness. He got into a physical altercation with the bus driver while on public transit coming from school. He was a student trying to get to or from school and asked the driver for a courtesy ride.Which poor students often do this on a daily basis. The driver said NO, and some how it escalated and got out of control from there. Another passenger and the bus driver held him down until the sheriff arrived. Anyway they(the police report) claim it was assault with a deadly weapon and he, the young man, claims, he didn’t have ANY weapon. It’s an old case and I recall the judge looking at the video on the bus and audibly saying she couldn’t figure out what was going on in the scuffle. I would like to know how this young man can get this case thrown out? How can I help him get essential elements, rules of evidence,courtroom objections so that the case can be dismissed. He doesn’t have any idea of how to defend himself. But with this course perhaps I can help him. I am in California, by the way. So if. ANYONE have any advice or ideas, I am open.
