Please someone ANYONE what’s my options?

Ok in 2017, I was arrested then shot twice while in handcuffs. October 2019, when I got out of prison I was served with a civil suit. One of the cops had said I “crushed him” with the car. I didn’t, but anyway…the judge let the suit move forward without ever notifying me. It was seven months in before I found out. I was being sued for “negligence and personal injury” for $240,000. Last week I was able to get it dismissed. So this must mean that I never really “crushed” him, which also means they never really had a reason to shoot me. Can I do anything now? Like maybe atleast get all them felonies removed? Thanks

See if there is an organization in your local area that helps get your record expunged or sealed either for a low cost or free. In my area the organization is called LegalWorks. I am not sure however if they just work with misdemeanors. Alternatively, check the code (state law) for the procedure to have your record expunged or sealed and if that applies to felonies as well. Is there a period i.e., after so many years that the record can be sealed in your state? Follow the procedure outlined in the code and the rules of criminal procedure in your state. This will probably entail filing motions etc. so this course is applicable and can help with that part.

I'm going to say it appears as if they damaged you and you could sue them for bodily harm when it was completely unnecessary. However, I'd have to know the rest of the details which means you'd have to get some evidence in discovery. The rules are stricter for criminal than civil. You may have a good chance but I would say you need to study the course and weigh your options. After you take the course, you'll know more than you do right now if you haven't taken the course yet.

Thanks y’all for replying back. An update to the case…it didn’t get dismissed. It was an agreed order with dismissal. I went 4 different times to court. All 4 times, the plaintiff nor his lawyer appeared. I moved to dismiss and the court never would. There was never a meeting of the minds, an agreement, but the judge was in favor of the plaintiff. I filed a motion to reconsider and he denied me. He violated my rights…I didn’t get a chance to face my accuser. The plaintiff won with zero evidence, while I’ve got really good factual admissible evidence. I appealed to the Kentucky court of appeals. I’m sending in evidence now.

I am close to filing three civil complaints for various causes of actions, against multiple defendants.

Alex,

You should consider filing a petition to vacate a void judgment in a different court away from that judge.

This can be done in another state court, or, in federal court as your federally protected rights to due process were violated.

Like Doc Graves says, at the end of the day, evidence is what wins cases and the moving party from what I can see hasn't brought any evidence to the court record so the court is without subject matter jurisdiction to issue judgment in the plaintiff's favor. Sounds more like a "good-ole-boys" club to me.
