Hearsay when a child is involved (the only witness
06/01/22 5:21 PM

A man is accused of molesting (touching) a child. The mother files for a restraining order.
Isn't the testimony of the mother to what her child told her Hearsay? Will it be allowed?
The man, by the way, is innocent.

There are a lot of questions in your question. How old is the man? How old is the child? How were the two together? Were they alone? How old is the mother of the child? What is the motive of the mother asking for the restraining order? Courts do allow hearsay evidence. It will be contingent on the information provided. This is why the ages come into play and the other questions I have presented.
