Good luck to you and to all of us in our pursuits for justice - if you haven't already read the definitions of the words the definitions of God and justice equity law - this is what made me purchase this course I have a dependency case with two sons a family law case with one son unlawful detainer case non disclosure real estate harassment discrimination in real property sales all same house purchase and rental I have a minor criminal case all these cases are started 2015 I'm a disabled person my federal rights violated my children unlawfully unjustly removed from my care and custody no reasonable accommodations discriminated against by judge in open court because of mental health disability the truth is preposterous I ha e a hard time believing myself the truth and that discrimination and governmental employees so regularly violate parents constitutional rights and have no training about federal rights or ADA or PAIMI or the hardships children and parents endure when separated and the damage and abuse the government is in a consistent regular and frequent habit of conducting interrupting the bond of parent and children to gain personally and financially by receiving federal financial assistance for these abuses of parents and children by unlawfully searching and seizing our children the USA has failed to ratify the children's rights treaty the only united nation in the world to not give our children rights - I believe I have come up with a solution to cease the "protection" of the children by the county government of states in the USA the "protection" of children never abused or neglected whom are taken from loving caring parents and for the first time suffer abuse at the hands of the government claiming to the federal government to be "protecting" - the federal financial assistance from the federal government goes to the state general fund line item budget not earmarked to go to the county for protection services or dare I say any of the funds earmarked for reunification services oh no it's just funding into state General fund line item in the state budget - we must cease the "protection" of the children by the county government of states in the USA the "protection" of children never abused or neglected whom are taken from loving caring parents and for the first time suffer abuse at the hands of the government claiming to the federal government to be "protecting" - the federal financial assistance from the federal government goes to the state general fund line item budget This is a regular way the state obtains millions of federal dollars directly into state general fund line item no matching requirements no restrictions on how it may be allocated at all just free federal obey for states money that may be spent on anything the state wants no requirements that it go for anything to do with protection of children or to the county that protected children oh and the county has taken my life insurance benefits for my children of $960 and the county can also require me to pay child support even if they terminate my parental rights oh dear lord God this abuse of our most precious resource our children and the destruction of our families must cease I have hope that the collective good will continue to always keep at bay those individuals who threaten our national motto - one nation under God - may it be that the light of Liberty be made not dim by the government violating our civil rights our constitutional Liberty interests and our children's and our human rights - may we all learn to win I paid for this course because I believe the definitions of the authors words and I wa to to teach my children to win and I believe I believe that good always will prevail over evil and that those without God who lie in court who use falsehoods to manipulate the judicial system these individual few must be kept at bay by us the collective good and we must fight we must win for the sake of our children to ensure the torch burns bright and is passed along for our children's children and all free men of this world - oh please everyone answer me this why has the USA failed to ratify the children's rights treaty? Why do we not hear of this why is there no help for natural parents in dependency court cases why is it allowed for social workers hearsay testimonial interviews in reports to be admitted as evidence when it's not legally admissible evidence why did I get an appointed counsel who is paid by the county and the worker who removed children paid by county the county counsel paid by county the referee and judge and children's appointed counsel all paid by county all county employees how is this allowed the only interest of these county employees in the farce "family court juvenille dependency" in Sacramento county superior court is the interest in the balancing of the county budget the interest of the children is of no concern to anyone of the county employees I've interacted with or met or had any dealings with in Sacramento or placer county I know this is of no interest to anyone this country has done a great job of ensuring any parent who has Cps take their children away is guilty guilty guilty I agree with you all I do I would protect my children from the person the Cps describes in the social worker reports and the court reporters investigational reports oh and the minutes taken by county counsel yep all the information in the entire case file that describes a mother a woman whom I myself want my children protected from yes please oh wait a second that person described does not exist my Liberty interest in my good name has had genocide completed against it because that person described and defined whom does not exist has been given my name - the things said about me and things alleged I have done are false and it is criminal to destroy a persons character the way mine has been destroyed why is this allowed why do we not care why do we not believe these innocent parents why is there no help why will no one even hear these parents once I have my children back I pray that I may never forget that I may always listen and always work for the rest of my life to cause an end some impact legislation I wa t the federal funding to be required by the federal government to be added to the state budget in a new line item titled "natural parents and childrens familial association security fund" let's work together using this course to sue the counties via 1983 under color of law for violations of our federal rights for county failure to train employees on parents federal rights parents constitutional rights lets bankrupt the counties there is a blue print for us all to follow search for this case Deanna fogarty hardwick vs Orange County the mother was awarded 9.5 million dollars for violations of her constitutional rights by county child protection practices and procedures even the social workers ordered to pay damages no qualified or absolute immunity applies when social workers act maliciously and when they make false allegations or when they threaten together we must proceed helping one another please help me reply with your stories reply with your advice reply with your comments you questions your answers just reply and here let's share our most helpful advice with each other here lets stand together and here lets win together lets win back our children

I am in MN with my sons, who both are plus one sons wife are fighting to get their first little boy home who was carry and take from Maternal GMA on lies. She used the color of law to claim abandonment, when infact my DIL was living with her the entire time. Its been 3 years since they have seen him, MIL Personality disordered and also Parental alienation. the play "pig in the middle with their son, and never answer phone calls or letters, when they go to see him, he is never there:.
and since have a new baby boy who is 2, neither of which know each other exists. I have been studying both Juris and also Karl Lentz, (he is a personal friend of mine) I am also very involved in some of the skype rooms and also many FB rooms.
oh, and i must add, fighting to get my nephew back who is a vulnerable adult in which the state is literally killing him. He is a 2 million dollar ticket at least. I also believe they have an RFID chip in his head.. that is another huge story.

My ex filed for a expedited temporary custody hearing accompanied by a affidavit in North Carolina. Can anyone tell me if I need to submit a rebuttal affidavit?

You MUST reply to your opponents affidavit within the given time limit with your own "certified affidavit"...meaning notarized.

Each claim of your opponent's affidavit must be rebutted, point-by-point. Failure to do so is call acquiescence, in which you agree with your opponent's claims.

The affidavit must be submitted by the parties with first-hand knowledge. Their attorneys are not allowed to write the affidavit.

Dr. Graves really needs to do a section on CPS. When people apply for a marriage license, they bring the State into their family lives. Check Black's Law Dictionary. All licenses are basically permission from the State to conduct business/commerce within their jurisdiction.

You do NOT need permission from the State to get married. Do to ignorance people agreed make the State a 3rd party in their marriage. This is called an Adhesion Contract.

And you don't have Constitutional Rights. Your Rights are given to you by your Creator. The Constitution is charged with securing/protecting your Rights.

Another point in the Constitution is Article I, section 10:
No State shall...impairing the Obligation of Contracts.
Basically, you are completely free to enter into unfair contracts.

My final point: The side bringing forth the claim, bring for the Law. Therefore, if your opponent cites you with a statute violation, you can't argue the Constitutional Law.
If your opponent brings forth a claim under Federal Law, you can't argue State Law.

What you need to do is file a counter-claim to argue your point of law. Dr. Graves course covers this topic.

I relocated 15 miles from my previous residence. Of course my ex petitioned the court for full custody, with the reason being a substantial change occurred (my move). Currently custody is 50/50 and I live in NY in the 4th appellate district. there seems to be very little case law when the relocation is less than 50 miles. Does anyone know where I can find the threshold of too far, in reference to non-custodial parent relocation??

15 MILES is nothing, but you probably have a lawyer on the other side trying to make a federal case out of this. Study my FAMILY LAW class where you will learn about the UNIFORM CHILD CUSTODY ACT that you should memorize! THEN TELL EVERYONE YOU MEET ABOUT HOWTOWININCOURT.COM

I have studied this ENTIRE course, and although it has been truly helpful, I remain a bit confused about issues in family law. Due to family law involving issues that may be different from "causes of action", in addition to child custody being an issue that pretty much is hand in hand with divorce cases, it is hard to figure out where I am to start since my case is continued on from my divorce. Maybe I'm making it more difficult than it is??? Not sure. Still, I would like to see more information here about family law.

I am in a situation where the spouse took the children out of state without notifying me and of their location. She attempted to place a TRO on me in her state. I did not know if the children were alive until over two months passed by. I was able to get the divorce custody proceedings back in my state. The children still have not been able to be returned over 1.5 yrs. I find I am missing something here. I would think by what I find in UCCJEA section 311 would allow me to petition for the enforced return of the children to their rightful home.
