Hello,

Credit card plaintiff files in Wisconsin Circuit Court an Affidavit Supporting Motion for Summary Judgment from an Affiant residing in Kentucky. Kentucky Affiant says she is custodian of records yet I cannot cross-examine her as she is out of state with an unknown address. Is it fair to say that the Affidavit is Hearsay and cannot be admitted as evidence? How do I object in writing? Should I move the Court to strike the Affidavit as Hearsay? Thank you!

You must rebut the affidavit in writing with the court and give them opportunity to rebut or respond to yours.
I would request actual evidence that they loaned you money. Where did it come from ?
demand an original accounting adhering to GAAP (?) accounting rules. NOT LEGAL ADVICE
